One of the implications of revoking the Regulation of the Minister of Law and Human Rights Number 34 of 2021 is that the foreigner can no longer apply for an onshore visa in Indonesia.
The Indonesian Government issued Regulation of the Minister of Law and Human Rights Regulation Number 19 of 2023. It revoked the Regulation of the Minister of Law and Human Rights Number 34 of 2021 concerning Granting Visas and Immigration Stay Permits during the Handling Period of the Spread of Corona Virus Disease 2019 and National Economic Recovery.
In this case, following up the confirmation of immigration policies regarding visa services and visit stay permits, visas and limited stay permits, as well as visit visa-free.
1. Onshore Visa
An onshore visa is a visa that can be obtained when the foreigner is already in Indonesia, according to the Regulation of the Minister of Law and Human Rights No. 34/2021 allows foreign nationals to obtain visas with their existing presence in Indonesia.
However, with the Regulation of the Minister of Law and Human Rights No. 19/2023 which makes the Regulation of the Minister of Law and Human Rights No. 34/2021 has been revoked, the application for obtaining a domestic visa has not been re-enforced after the Regulation of the Minister of Law and Human Rights 19/2023 was promulgated on 7 June 2023.
2. Revocation of the Circular Letter on the COVID-19 Circumstances
Revocation of Regulation of the Minister of Law and Human Rights No. 34/2021 has been revoked since the promulgation of Minister of Law and Human Rights Regulation No. 19/2023, which states that regulations regarding the granting of visas and immigration stay permits during the handling of the spread of Corona Virus Disease (Covid-19) and social economic recovery are no longer valid due to the endemic transition to Covid-19.
3. Alternative scheme since the onshore visa no longer applies
Due to the inability to apply for an Onshore Visa, there are several alternative schemes for this, as follows:
- For visa holders, if you wish to continue your visa in Indonesia, you can choose an alternative to leave Indonesia first and then obtain a new visa by an offshore method.
- For residence permit holders, they can do an EPO (Exit Permit Only), then they can leave Indonesia and obtain another Visa or Stay Permit by offshore.
- For holders of a Temporary Stay Permit (KITAS) valid for 1 (one) year, conversion can be made to a Permanent Stay Permit (KITAP) which is valid for up to 5 (five) years if certain conditions are met.
