Indonesian Mixed Marriage Assistance

Husband and wife can create a marital agreement, either prenuptial or postnuptial. The content of the agreement could be about anything as long as it doesn’t violate any prevailing laws and regulations. However, in order for the agreement to be binding, it has to be legalized by either marriage registrar or public notary and then registered at Civil Registration. For the registration, in addition to the legalized agreement itself, these following documents are also required:

  1. ID Card (KTP);
  2. Family Card;
  3. Marriage certificate;
  4. Proof of marriage report to Indonesian consulate (in the event the marriage was held overseas).

  5. Registering the Prenuptial Agreement at the District Court and at the Marriage Registry.

Time Frame: 5 (five) working days.

Mixed marriage is a marriage between Indonesian people from different countries. The marriage itself could be done either in Indonesia or overseas, and it’ll still be considered as valid as long as it abides both country’s prevailing regulations. For the Indonesia side, there are some regulations to be considered:

  1. The legal age of marriage for man is 19 years old, for a woman it’s 16 years old;
  2. Marriage between blood-related people is forbidden;
  3. Marriage is strictly monogamous, except for Muslim;
  4. Marriage is valid when it abides the religious regulations of both the bride and the groom;

In order to prove that the couple has abided to both their respective country and religion prevailing regulations, they would have to acquire a certificate of no impediment. In order to acquire this certificate, the followings documents are required:

  1. Birth certificate;
  2. ID Card;
  3. Passport;
  4. Letter of Domicile.

If the marriage was done overseas, they would need to report it to Indonesian consulate overseas by submitting the marriage certificate and the travel documents. Afterwards, they would have to register the marriage to their respective country’s authority. The purpose of this registration is so that the country recognize their marriage, thus which authority they need to register their marriage to is actually depends on where the marriage takes place and where they will live. If they decided to live in Indonesia, they would have to register their marriage to Indonesian civil registration, even if the marriage took place overseas. For the registration at civil registration, these following documents are needed:

  1. Proof of marriage report to Indonesian Consulate
  2. Marriage certificate;
  3. Photo of the husband and wife;
  4. Family card;
  5. ID card;
  6. Death/divorce certificate of the previous partner (if any);
  7. Travel document;
  8. Resident Certificate;
  9. Approval from the foreigner’s country authority.
