How to Convert Investor KITAS to Investor KITAP

“Residence Permits that have been granted to Investors, it can be converted into Permanent Stay Permits that are valid for 5 (five) years and can be extended indefinitely.”

I. Differences between KITAS and KITAP Investor:

Investor KITAS is a license granted to an Investor to stay and be in the Territory of Indonesia for a limited period 1 (one) or 2 (two) years. Residence Permits that have been granted to Investors can be converted into Permanent Stay Permits.

Investor KITAP is a license granted to an Investor to reside and settle in the Territory of Indonesia as a resident of Indonesia for 5 (five) years and can be extended for an unlimited period. Holders of Permanent Stay Permits for an unlimited period must report to the Immigration Office every 5 (five) years and are free of charge.

II. Requirements to Convert from KITAS Investor to KITAP Investor:

Provisions on the requirement to transfer the status of a Limited Stay Permit to a Permanent Residence Permit for Investors are regulated in Article 50 of the Republic of Indonesia Investment Coordinating Board Regulation No. 6 of 2018 concerning Guidelines and Procedures for Licensing and Investment Facilities, namely:

a. Investor and serves as a Director of the company with the terms of ownership of at least Rp1,000,000,000.00 (one billion Rupiah) or equivalent to the United States dollar; or
b. Investors and not as a Director of a company with the terms of ownership of at least Rp10,000,000,000.00 (ten billion Rupiah) or equivalent to the United States dollar;
c. The investor has been in the Territory of Indonesia for at least 4 (four) consecutive years since the date the limited stay permit was granted;
d. Submitted within 30 (thirty) days before the Limited Stay Permit period ends.

III. Document Requirements for KITAP Investor:

  1. Fill in the Immigration Application Form, namely: Limited and Permanent Stay Permit Form, Re-entry and Return Permit Form, Foreign Data Change Form;
  2. Application Letter;
  3. Power of Attorney + Identity Card of the person receiving the power of attorney;
  4. A valid national Passport (Visa, Entrance Certificate and Stay Permit);
  5. KITAS Investor who shows that the Investor has lived in the territory of Indonesia for more than 3 (three) consecutive years;
  6. Certificate of Residence by the Civil Registry Service Office;
  7. Integration Statement signed by the person concerned; and
  8. Recommendations from the Investment Coordinating Board.

IV. Procedure to convert KITAS Investor to KITAP Investor:

An application for a change of status of a Limited Stay Permit to a Permanent Stay Permit is submitted to the Head of the Immigration Office whose working area covers the Investor’s residence with the following stages:

a. Completeness check of requirements;
b. Data entry, file scanning, and print of application;
c. Payment of immigration fees in accordance with statutory provisions;
d. Data identification and verification;
e. Field Immigration supervision, if needed in accordance with the consideration of the Head of the Immigration Office or the appointed Immigration Officer;
f. Making and signing of a letter of application for the Head of the Immigration Office to the Head of the Immigration Division with consideration and advice;

In case the application is approved, the Head of the Immigration Office carries out the transfer of the status of a Limited Stay Permit to a Permanent Stay Permit through a mechanism:

a. Interviewing, identifying and verifying data and taking Biometric Data on photographs and fingerprints;
b. Issuance of Permanent Stay Permit card and stamp of Permanent Stay Permit at the same time contain Re-entry Permits that are valid for 2 (two) years on the National Passport;
c. The signing of the Permanent Stay Permit card and the impression of the Permanent Stay Permit stamp by the Head of the Immigration Office or the appointed Immigration Officer;
d. Document scan complete; and
e. Document submitted.

Time frame: approximately 20 (twenty) working days after the application is received completely and correctly.
