NIB as General Importer Identification Number

NIB is proof of registration for Business Actors to carry out business activities and as an identity for Business Actors. Moreover, after the activation, NIB can also apply as API for import activities of traded goods or goods for their own use.

A. Overview on NIB

Business Identification Number (“NIB”) is proof of registration for Business Actors to carry out business activities and as an identity for Business Actors in carrying out their business activities. NIB is issued by the Online Single Submission (“OSS”) and must be owned by every business actor. Business actors can only have one NIB. The NIB is in the form of a random number which is secured and accompanied by an electronic signature. NIB contains as follows:

1. profile;
2. business capital;
3. Tax Number;
4. KBLI; and
5. Business location.

NIB is valid as long as the Business Actor carries out business activities in accordance with the provisions of statutory regulations, and can be revoked and declared invalid if:

1. Business actors carry out business activities that are not in accordance with the NIB
2. Business Actors violate the provisions of laws and regulations related to Business Licensing;
3. approval of the Business Actor’s application for revocation of NIB;
4. dissolution of business entities; or
5. based on a court decision that has binding legal force

As explained above, the NIB is the identity of the business actor, but the NIB can also apply as follows:

1. Import Identification Number (“API”) as intended in the laws and regulations regarding import identification numbers;
2. Customs access rights as intended in customs laws and regulations;
3. Registration of Business Actor participation for health social security and employment social security; And
4. Mandatory employment report for the first period of the Business Actor.

B. NIB as Import Identification Number               

Import is the activity of carrying goods into the customs area, while an importer is an individual or institution, or business entity, whether in the form of a legal entity or non-legal entity, which carries out the import activity. Importers are required to have an NIB that is valid as an API. API is divided into two types, which are:

1. general import identification number (“API-U”) for import activities of traded goods; or
2. producer import identification number (“API-P”) for import activities of goods that are used as capital goods, raw materials, auxiliary materials, and/or materials to support the production process.

Importers can only choose their NIB to apply as API-U or their NIB to apply as API-P.

C. Procedures and Requirements for NIB Activation as API

Therefore, to carry out business activities in the import sector, you must first arrange the NIB which is done through the OSS system. As explained above, NIB has a function as the identity of business actors and can be applied as an API. So the NIB needs to be activated first so that it can become an API. This activation is carried out through OSS when filling in data so that the NIB can be applied as an API. The requirements needed to create a NIB are Data on Business Actors and General Plan of Business Activities.

Business actor data for individuals, consists as follows:

1. name and national identity number;
2. Tax Number of individuals;
3. capital plan; and
4. Cell phone number and/or electronic mail address (email).

Business actor data for business entities, consists as follows:

1. name of business entity;
2. type of business entity;
3. investment status;
4. number of the deed of establishment or registration number along with its endorsement;
5. correspondence address;
6. the size of the capital plan;
7. management and shareholder data;
8. the country of origin of the investor, in the event that there is PMA;
9. aims and objectives of the business entity;
10. business entity telephone number;
11. electronic mail (email) address of the business entity; And
12. Tax number of business entity.

The general plan of business activities, consists as follows:

1. business scope according to the standard classification of Indonesian business scope;
2. business location;
3. customs access;
4. importer identification number;
5. participation in health and employment insurance; And
6. employment report status

D. Conclusion

NIB is proof of registration for Business Actors to carry out business activities and as an identity for Business Actors in carrying out their business activities which is issued by the OSS, and must be owned by every business actor. NIB can also be applied as an API, which is divided into API-U and API-P, and you can only choose one of them. The NIB needs to be activated first so it can become an API. This activation is processed through OSS when filling in the data so that the NIB can be applied as an API.
